ARTICLE 1:

SCOPE AND AMENDMENT OF THE TERMS AND CONDITIONS OF SALE

These terms and conditions of sale apply to all orders placed on the website www.domux.eu.

The applicable terms and conditions are those in force on the day the order is confirmed.

ARTICLE 2:

CONFORMITY AND AVAILABILITY OF PRODUCTS

The products offered for sale by www.domux.eu are those shown on the website on the day the Buyer visits it.

Products are offered for sale while stocks last.

In the event of an error regarding the availability of an ordered product, www.domux.eu will inform the Buyer by email or telephone as soon as possible. The Buyer may then have the product replaced by another of equivalent quality and price, or cancel the order (refund).

The products offered for sale are described and presented as accurately as possible. www.domux.eu cannot be held liable for any error or omission in this presentation. Photographs and texts illustrating the products are for information only and are not contractual.

ARTICLE 3:

PRICES

Prices shown on the website are in euros including all taxes, excluding shipping costs.

ARTICLE 4:

ORDER CONFIRMATION AND ELECTRONIC SIGNATURE (FRENCH LAW OF 13 MARCH 2000 ON ELECTRONIC SIGNATURES)

Any order form signed by the consumer by "double click" constitutes an irrevocable acceptance that may only be challenged within the limits provided for in these terms and conditions of sale.

The "double click", combined with the authentication and non-repudiation procedure and the protection of message integrity, constitutes an electronic signature. Between the parties, this electronic signature has the same value as a handwritten signature.

ARTICLE 5:

PAYMENT METHODS AND SECURITY

Payment methods

You can pay:

By bank card:

Accepted cards: Carte Bleue, Visa, Mastercard, American Express

By bank transfer:

Our bank details will be displayed once the bank transfer method is selected.

The order will only be confirmed once the transfer has been received.

By cheque:

Cheques must be issued in euros by a bank based in France. The cheque is cashed on receipt.

The Buyer must send it to the following address:  CASABILL, 21 avenue de Mimet, 13380 Plan-De-Cuques, France, payable to CasaBill.

When paying by cheque, the order will only be processed once the cheque has been received.

By PayPal:

To use this payment method, you must have a PayPal account. When paying by PayPal, PayPal's terms of use apply.

Non-payment:

www.domux.eu reserves the right to refuse to deliver or fulfil an order from a consumer who has not paid all or part of a previous order, or with whom a payment dispute is in progress.

ARTICLE 6:

FRAUD / RIGHT TO REFUSE AN ORDER

CASABILL reserves the right to cancel or refuse any order that shows:

a payment incident or suspected fraud.
one or more risk factors of fraudulent use of a bank card and/or bank account.
an attempt to deceive or suspected misuse of loyalty points.
one or more errors on our website (price, description, photo, …).
a technical problem preventing the order from being processed.
CASABILL reserves the right to check the personal data provided by the customer and to take any measures deemed necessary to verify that the person whose bank account is debited is indeed the person who placed the order, in order to prevent fraudulent payments. This check may take the form of a request for proof of identity and/or address and/or bank documents (bank details or cancelled cheque) and/or a company registration certificate (for businesses). If the customer does not respond to such a request within 2 days, the order concerned will be cancelled automatically, with no possibility of subsequent claim.

CASABILL reserves the right to cancel or refuse any order from a customer listed in our database (fraudulent customers). The customers concerned will be informed individually.

In the event of fraud, the order will not be processed and legal proceedings will be brought systematically.

By confirming your order, you accept these terms.

ARTICLE 7:

ORDER

Any order constitutes the Buyer's express and irrevocable acceptance of the prices and descriptions of the products available for sale, and of these terms and conditions.

Once the order has been confirmed, www.domux.eu sends the Buyer a confirmation email to the address provided during the order.

ARTICLE 8:

SHIPPING AND DELIVERY

Ordered products are sent to the delivery address provided by the Buyer when placing the order.

All lead times are calculated in working days (subject to confirmation of your order). The delivery date takes into account the preparation and dispatch time plus the carrier's delivery time (La Poste / Chronopost / Colissimo / UPS / GLS).

Delivery to mainland France and internationally (special rates).

ARTICLE 9:

RIGHT OF WITHDRAWAL

The Buyer has fourteen (14) clear days from receipt of the products to exercise the right of withdrawal without having to give reasons or pay penalties, with the exception of return costs.

If the fourteen (14) day period ends on a Saturday, Sunday or public holiday, it is extended to the next working day.

If the right of withdrawal is exercised, www.domux.eu will refund the Buyer all sums paid as soon as possible and no later than seven (7) days after receiving the returned product.

The product returned by the Buyer must be in its original packaging, complete and not damaged by the Buyer; otherwise www.domux.eu reserves the right to refuse the withdrawal.

ARTICLE 10:

RETURNS

The Buyer has fourteen days from receipt of the order to return a product. After this period, the delivered products will be deemed compliant and accepted by the customer, and www.domux.eu reserves the right to refuse any exchange, credit note or refund.

The returned item must be in its original packaging and accompanied by the completed return form.

Any return of an order without our agreement will not be processed and the customer will bear the cost of sending the order back.

No return will be accepted or processed if sent without prior agreement from the after-sales department.

ARTICLE 11:

WARRANTIES AND LIABILITY

www.domux.eu is liable for any lack of conformity existing at the time the product is delivered.

If a non-compliant product or a product with a hidden defect is delivered, www.domux.eu undertakes either to refund the Buyer the price of the product, or to exchange it for an identical product subject to stock availability, or to exchange it for a product of equivalent quality and price subject to stock availability.

The warranty does not cover products damaged in transit or through misuse.

The warranty does not cover any product that has suffered physical damage (broken glass, cut or replaced cable, product opened, modified components, etc.).

The warranty does not cover incorrect handling of the product or faults resulting from failed updates.

The warranty does not cover misuse of cameras: indoor cameras used outdoors.

The warranty does not cover damage caused by the environment: storms, fire, flood, etc.

www.domux.eu cannot be held liable for failure to meet its contractual obligations due to an unforeseeable event or force majeure, as defined by case law.

Warranties

All our FOSCAM products have a 2-year return-to-workshop warranty unless otherwise stated.

The warranty on accessories and home automation products is 1 year.

The warranty on refurbished products, including their accessories, is 3 months.

Breakage insurance

www.domux.eu does not offer any breakage, theft or loss insurance.

After-sales service

If a product ordered from www.domux.eu breaks down, go to your Customer Account to see how your product will be handled.

Handling conditions may vary depending on the agreements between www.domux.eu and the manufacturers.

You may therefore be asked to:

Either return the faulty product directly to us so that we can send it to the manufacturer or to a technical centre approved by the manufacturer,
Or send the product directly to the manufacturer so that it can carry out the repair,
Return costs in connection with after-sales service are borne by the customer.
ARTICLE 12:

PERSONAL DATA

www.domux.eu undertakes to respect the confidentiality of the personal data provided by the Buyer on the Website and to process it in compliance with the French Data Protection Act of 6 January 1978 and the GDPR.

In accordance with the French Data Protection Act of 6 January 1978 and the GDPR, the Buyer may exercise the rights of access, objection, rectification or deletion of their data by sending a request by email to contact@casabill.com or by post to CASABILL, 21 avenue de Mimet, 13380 Plan-De-Cuques, France.

ARTICLE 13:

INTELLECTUAL PROPERTY

All elements of the Website are protected by copyright, trademarks or patents.

They are the exclusive property of their authors.

ARTICLE 14:

APPLICABLE LAW AND COMPETENT COURTS

These terms and conditions of sale are governed by and interpreted in accordance with French law.

In the event of a dispute, the Buyer undertakes to contact www.domux.eu first in order to try to settle amicably any disagreement that may arise between the parties.

Failing an amicable settlement, the French courts shall have sole jurisdiction.

ARTICLE 15:

AMENDMENTS TO THE TERMS AND CONDITIONS OF SALE

www.domux.eu reserves the right to adapt or amend these terms and conditions of sale at any time. In the event of amendment, each order will be subject to the terms and conditions in force on the day of the order.
